1. Acceptance of these terms

These Terms of Service (“Terms”) govern your use of this website and the partner dashboard (together, the “Service”), provided by Iconic Apps, operated by Arham Web Works Private Limited. By accessing or using the Service you agree to these Terms. Participation in the partner program is additionally governed by the Affiliate Policy; if the two conflict, the Affiliate Policy prevails for Program matters.

2. Your account

• You must provide accurate information and keep it up to date.
• You are responsible for keeping your password confidential and for all activity under your account. Tell us promptly if you suspect unauthorised use.
• You must be at least 18 years old, or have reached the age of majority where you live.
• We may suspend or close accounts that breach these Terms or the Affiliate Policy.

3. Acceptable use

You agree not to:

• use the Service unlawfully, or to infringe anyone’s rights;
• attempt to gain unauthorised access to the Service, other accounts, or our systems;
• probe, scan or test the Service’s security, or interfere with its operation (including by automated scraping or overloading it);
• reverse engineer or copy the Service except as the law allows;
• use the Service to harvest information about merchants or other partners.

4. Intellectual property

The Service, including its design, text, graphics and software, and the App names and logos, belong to us or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. You keep ownership of content you submit, and give us a licence to use it as needed to run the Service and the Program.

5. Third-party services & links

The Service links to or relies on third parties — for example Shopify’s App Store and PayPal. We do not control them and are not responsible for their content, availability or practices. Your use of them is subject to their own terms.

6. Availability & changes

We work to keep the Service available but do not guarantee uninterrupted access. We may change, suspend or discontinue any part of the Service, with notice where reasonable.

7. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Dashboard figures are provided for information and may be delayed or corrected as data syncs.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the Service. Our aggregate liability for claims relating to the Service is limited to the greater of US$100 and the amounts paid or payable to you in the preceding twelve months. Nothing in these Terms limits liability that cannot be excluded by law.

9. Termination

You may stop using the Service and close your account at any time. We may suspend or end your access at any time, including for breach of these Terms. Sections that by nature should survive termination will survive.

10. Changes to these terms

We may update these Terms. The updated version will be posted here with a new “last updated” date, and for material changes we will give reasonable notice. Continuing to use the Service after a change means you accept it.

11. Governing law

These Terms are governed by the laws of India, and the courts of that jurisdiction have exclusive jurisdiction over disputes, subject to any mandatory consumer protections that apply to you.
